Terms of Use

1. Acceptance of terms

By downloading, accessing, or using the Goba app (the "App"), you agree to these Terms of Use (the "Terms") and to our Privacy Policy. If you do not agree with these Terms, do not use the App. Operator: Valerii Lesko Contact: info@goba.app

2. Who may use the App

The App is intended for users 16 years of age and older. By registering, you confirm that you are at least 16 years old and have the legal capacity (or the consent of a parent or legal guardian where required) to enter into this agreement.

3. Account

Sign-in is securely handled via Apple or Google. You are responsible for keeping access to your device and account secure, and you are responsible for all activity that occurs under your account. You may delete your account at any time within the App (Profile → Delete profile).

4. Acceptable use and zero tolerance

The App contains user-generated content (UGC) and facilitates communication between strangers. We maintain a zero-tolerance policy regarding objectionable content and abusive behavior. You agree NOT to post content or engage in activity that:

• Is illegal, threatening, abusive, discriminatory, harassing, or constitutes hate speech or bullying;
• Contains pornography, nudity, or sexually explicit or sexualized material; or any sexual content involving minors (including child sexual abuse material);
• Promotes violence, incitement to violence, or self-harm;
• Involves spam, fraud, phishing, or unauthorized commercial advertising;
• Impersonates others or shares someone else's private, personal information without their consent;
• Violates the intellectual property or privacy rights of third parties.

5. Your content

The content you create (topics, messages, photos, reviews) remains yours. However, by posting it, you grant the Operator a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and transmit it to other users to the extent necessary to operate the App. You are solely responsible for ensuring you have the right to share the content you post and that it complies with the law.

6. Our Intellectual Property

While you own your content, we own the App. The App’s design, code, logo, text, and graphics ("Goba IP") belong to the Operator. We grant you a personal, worldwide, non-transferable license to use the App for your personal, non-commercial use. You may not copy, modify, distribute, or reverse-engineer the App or its parts.

7. Moderation, reports, and enforcement (Important)

• Images may be automatically screened and automatically hidden pending review, in addition to review of user reports.
• The App provides built-in tools for you to report inappropriate content and to block other users.
• We review reports of objectionable content and remove infringing content and eject violators (by blocking or deleting their accounts) within 24 hours of receiving a valid report.
• We reserve the right, at our sole discretion, to remove any content and to restrict, suspend, or terminate your access to the App for violations of these Terms—with or without notice—to maintain a safe environment.

8. Safety when meeting strangers

The App uses location features to show topics and people nearby, but it does not conduct background checks or verify users' identities. Any communication, sharing of information, or real-life meetings are solely at your own risk. Be careful: do not disclose sensitive personal or financial data, always meet in public places, and trust your instincts. The Operator is not responsible for the conduct of any user on or off the App.

9. Location

The App uses your device's location to show nearby activity. Your precise coordinates are permanently coarsened/offset before being displayed to others. You can disable location tracking at any time via your device settings and choose a city manually.

10. Disclaimer and limitation of liability

The App is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied. To the maximum extent permitted by law, the Operator shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, nor for any user-generated content or actions of other users.

11. Indemnification

You agree to indemnify, defend, and hold harmless the Operator from any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any third-party rights.

12. App Stores

If you download the App from Apple or Google, you acknowledge that these Terms are between you and the Operator, not with Apple Inc. or Google LLC. Apple and Google are not responsible for the App, its content, or providing any maintenance or support services for it.

13. Termination

You may stop using the App and delete your account at any time. We may suspend or terminate your access immediately if you violate these Terms, create legal risk for us, or for any other reason at our discretion.

14. Governing law

These Terms shall be governed by and construed in accordance with the laws of Ukraine, unless the mandatory consumer protection laws of your country of residence require otherwise.

This agreement was originally written in English. If any translated version of this agreement conflicts with the English version, the English version shall prevail and control.

15. Changes

We may update these Terms from time to time. Material changes will be communicated via the App or by email. By continuing to use the App after changes become effective, you accept the updated Terms.
